Child Custody & Support Issues in Military Divorce
If you and your spouse have children, child custody issues can be difficult to maneuver when one spouse is an active service member. Deployment makes joint custody impractical and physical visitation impossible at times. In Utah, a deployed service member who is the noncustodial parent has the right to give his or her parent time rights to a close family member for the duration of their absence. This means that the service member’s relative – such as a parent or sibling – may be able to have visitation time with the child while the service member is deployed. Utah also has laws regarding child support for military service members. Child support payments cannot exceed 60% of the service member’s pay and/or allowances.
