How Does a Father Establish Paternity in Utah?

In Utah, fathers have different rights depending on whether or not they are married to the mother of the child. When a child is born to married parents, paternity is automatically established. Married fathers have the right to make decisions regarding legal, educational, health, religious, and welfare matters. However, unmarried fathers will face a few legal challenges when it comes to establishing paternity.

Unmarried fathers must prove paternity in one of two ways:

1) Taking a paternity test

2) Signing a Voluntary Declaration of Paternity

If there are any doubts over paternity, coming from either the mother or father, the father must take a paternity test. If the paternity test proves a biological connection, paternity is automatically established and the father has the right to file for child custody and visitation. The mother will then be able to file for child support.
